Fender Australia Pty Limited 5 Year Limited Warranty Fender Amplifiers (USA & Mexico) Fender Pro Audio Products and Fender Passport Effective Date: 1 June 2003 Important Information

Fender Australia Pty. Limited [ACN 001 648 602] ("Fender") warrants to the original purchaser of Fender products, that if used under normal operating conditions, and if regularly serviced by an Authorised Fender Dealer or Authorised Fender Service Centre, the product to be free from defects in materials and workmanship, subject to the limitations set forth below.

This warranty applies only to the original retail purchaser of the product, for so long as it is owned and used by the original purchaser and regularly serviced (not less frequently than yearly) by an Authorised Fender Dealer or Authorised Service Centre technician, and only when it is purchased in Australia from an Authorised Fender Dealer (a retailer authorised by Fender to use its Trade Marks). To claim under this warranty, the original retail purchaser, at the time the claim is made must supply proof, to Fender's satisfaction, of his/her original purchase of the Product (at least the original sales receipt which must contain the serial number and the purchaser's name), documentary evidence of service history, and must return the product to an Authorised Fender Dealer or to an Authorised Fender Electronics Service Centre within the applicable warranty period.

The warranty is for a limited period (following the date of the original purchase) of 5 years for all Fender Amplifiers (USA & Mexico) Fender Pro Audio Products and Fender Passport. Light bulbs, vacuum tubes and meters are covered for only 90 days and microphones and speakers are covered for 1 year and cables are covered for 30 days from date of original purchase.

This warranty does not cover:

• Normal wear and tear on any part of the product including input jacks, output jacks, controls and switches, plated surfaces, nuts, screws, strings, frets etc.
• Transportation, insurance or freight charges associated with warranty claims.
• Defects in finishes, or cracks, splitting, or warpage of wood, including those due to changes in temperature or humidity, exposure to sun, fire, moisture, body salts and acids, other chemicals or non-Fender supplied polishes.
• Product which has been serviced by unauthorised persons (any person other than Fender Authorised Service Centres and technicians holding a certificate of Warranty Service Authorisation for the period during which the work was performed).
• Any product whose serial number is missing, unable to be read, defaced or has been altered or tampered with in any fashion.
• Strings, frets, screws, batteries and other consumable parts.
• Case and case hardware wear and tear.
• Mic Clips & Battery Clips.
• Any product which has been hired out.
• All other defects and deterioration due to normal usage, aging, wear & tear, accidents, neglect, abuse, or acts of Nature.

If original materials or products are not readily available, alternative materials or products may be used for service, replacement or repair.

No person may remove any part, carry out, or attempt to carry out, any modifications, service or repairs except an Authorised Fender Service Centre and then only after first having obtained Fender's prior written approval. Repair service of defects covered by this warranty can only be performed only at the Authorised Fender Electronics Service Centre designated by Fender. Your Fender Dealer may also be authorised for warranty service and should be the first point of contact when service of any kind is required for any product.

Any damage or defect resulting from unauthorised removal, replacement or interference with parts or unauthorised service is excluded. Any repair or service performed by anyone other than an Authorised Fender Dealer or Authorised Fender Service Centre technician is not reimbursable and completely voids this warranty.

The foregoing constitutes the only warranty made or given by Fender with respect to the product and/or your purchase.

Except for such terms, conditions and warranties implied by statute, and which cannot be excluded, no term, condition, warranty or representation is applicable to, or to the purchase of, any Fender product and is expressly excluded, including in relation to the condition, or suitability, of the product, or its quality, merchantability, fitness for purpose, safety or otherwise. All terms, conditions, warranties and representations implied by law or statute are expressly excluded to the maximum extent permitted in Australia. The maximum liability for breach of any term, condition, warranty or representation, including those implied by statute which cannot be excluded, is limited, at the option of Fender, to the replacement of the goods, or the supply of equivalent goods, or the repair of the goods, or the payment of the cost of such replacement, supply or repair. To the maximum extent permitted by statute, all liability for personal injury, death or property damage howsoever arising, including resulting from failure of, or defect in, any product, or, in connection with the supply, assembly, installation or operation of any product is expressly excluded.

Under no circumstances is there, or can there be, any liability for any consequential loss or damages nor for loss of income, satisfaction and otherwise (including arising from unavailability or during service, repair or replacement).
